1endpoint’s role and responsibility for use
1endpoint provides a technical API gateway that automatically routes user requests to independent third-party model or service providers (collectively, “Providers”) and relays Provider responses back to the user. 1endpoint does not create Prompts on a user’s behalf, initiate requests, or decide the user’s purpose of use.
The user selects the model, Prompt, parameters, token volume, use of Output, and any action taken from Output. Token volume or the form of a request alone does not allow 1endpoint to know, verify, or fully control the user’s actual purpose. To the extent permitted by law, the user is solely responsible for their Prompts, Outputs, use decisions, and the consequences of their activity.
Output is generated by Provider systems and may be inaccurate, incomplete, outdated, misleading, or unsuitable for a particular purpose. 1endpoint does not verify, endorse, or warrant the accuracy, legality, originality, or safety of Output. Users must independently review Output before use and must not treat it as the sole source of professional advice, particularly for legal, medical, financial, employment, credit, or other decisions with a material effect on an individual.
The service is provided on an “as is” and “as available” basis. Availability, speed, limits, pricing, models, and response quality may depend on Providers, network infrastructure, or events outside 1endpoint’s reasonable control.
To the fullest extent permitted by law, 1endpoint is not liable for indirect, incidental, special, or consequential loss; loss of profit, revenue, opportunity, data, or reputation; or claims arising from Output, user conduct, user-connected systems, or Provider conduct outside 1endpoint’s reasonable control. If 1endpoint is nevertheless found directly liable, its aggregate liability arising from the same event will not exceed the amount the user actually paid to 1endpoint during the 30 days immediately preceding that event.
Nothing in this document excludes or limits any right, obligation, or liability that applicable law does not permit to be excluded or limited.
Data flow and third-party Providers
For API content, 1endpoint does not intentionally retain Prompt or Output content after a request has completed. A Prompt is processed transiently for the time needed to route it to a Provider, and the Provider’s response is relayed back to the user through 1endpoint.
The statement that content is not retained applies only to API Prompt and Output content. It does not mean that no transient transmission processing occurs, and it does not cover non-content operational data such as account details, model used, token count, timestamp, request status, billing data, or security indicators where such data is necessary to provide the service, bill usage, prevent abuse, or comply with law.
By submitting a request, the user instructs and authorizes 1endpoint to transfer the content needed to the Provider used to process that request. Providers are independent parties and may process, retain, or use data under their own terms, policies, and infrastructure locations. 1endpoint does not control and is not responsible for Provider data practices outside 1endpoint’s systems and reasonable control.
Users must assess whether a Provider is suitable and must not submit state secrets, confidential information, personal data, children’s data, or restricted data without all required rights, legal bases, notices, and consents. No transmission method can be guaranteed absolutely secure, and users accept the reasonable risks associated with the data they choose to include in a Prompt.
1endpoint may block or stop a transmission when needed to protect its systems, comply with a lawful request from a competent authority, or address suspected misuse.
Lawful-use requirement
Users may use 1endpoint only for lawful purposes and must comply with Vietnamese law, the laws applicable where they operate, third-party rights, and relevant mandatory Provider restrictions.
Users must not directly, indirectly, experimentally, or by assisting another person use 1endpoint to commit, facilitate, or conceal unlawful conduct, including:
- fraud, impersonation, theft, phishing, spam distribution, or intentionally misleading activity;
- unauthorized access, authentication bypass, malware distribution, vulnerability exploitation, system interference, or service disruption;
- infringement of privacy, personal-data rights, confidentiality, intellectual property, reputation, dignity, or another person’s lawful rights and interests;
- creation, distribution, or facilitation of child sexual exploitation material, unlawful violence, prohibited goods or services, or conduct creating real-world danger;
- circumvention of usage limits, safety measures, bans, or enforcement controls imposed by 1endpoint or a Provider.
Where there are reasonable grounds to suspect a violation, 1endpoint may reject requests, restrict access, suspend or terminate service, and cooperate with competent authorities as required by law. To the extent permitted by law, the user must reimburse direct losses, penalties, claims, and reasonable costs arising from their violation, except to the extent caused by 1endpoint’s fault.
